1. Acceptance
By accessing or using Confer, you agree to these Terms and to our Privacy Policy. If you use Confer on behalf of an organisation, you confirm you are authorised to bind that organisation. If you do not agree, do not use the platform.
2. What Confer is (and isn't)
Confer is a technology platform that facilitates remote surgical second opinions and related communication, scheduling, video consultation, and payment between patients, treating clinicians, and independent consulting surgeons. Confer is not a healthcare provider, does not practise medicine, and does not employ the consulting surgeons who provide opinions through the platform. Opinions and clinical judgements are those of the individual clinicians, not of Confer or TBHCI.
3. Eligibility & accounts
You must provide accurate information and keep it current. Access is via WhatsApp one-time passcode tied to your mobile number; you are responsible for keeping access to that number secure and for activity under your account. The same mobile number may hold separate patient and clinician accounts. We may refuse, suspend, or remove accounts at our discretion, including where information cannot be verified.
4. Consulting surgeons
Surgeons apply to join and are activated only after administrator verification of the credentials they submit. Surgeons represent and warrant that they hold valid, current licensure and are entitled to provide the opinions they offer; that they will provide opinions competently and professionally; and that they will not seek to identify or contact a patient outside the platform. Surgeons set their own consultation rate and are responsible for the tax and regulatory consequences of the fees they earn. Verification by Confer is an administrative check and is not an endorsement or a guarantee of any surgeon's competence or outcomes.
5. Patients & treating clinicians
Patients and treating clinicians are responsible for the accuracy and completeness of the information and files they submit, and for having the right to share any patient information they upload. A second opinion obtained through Confer supplements — and does not replace — care from your treating clinician. You should discuss any second opinion with your treating clinician before acting on it.
6. Nature of second opinions
A second opinion is an advisory, remote assessment based only on the information provided. It is not a diagnosis, prescription, or treatment plan, does not create a doctor–patient relationship unless separately established, and may be limited by the quality or completeness of the information supplied. Consulting surgeons do not physically examine the patient.
7. No emergency use
Confer is not for emergencies. If you are experiencing a medical emergency, call your local emergency number or go to the nearest emergency department immediately. Do not use Confer to seek urgent or time-critical care.
8. Payments & refunds
Some consultations — particularly cross-border or uninsured consultations — are self-pay. Fees are shown before you confirm and are processed by Stripe. A case is routed to the consulting surgeon only after payment is received. Because a second opinion is a professional service delivered upon review, fees are generally non-refundable once the surgeon has begun the review, except where required by law or approved by us in our discretion (for example, where a surgeon declines the case). A receipt is issued on successful payment.
9. Video consultations
Where offered, video consultations are hosted through an embedded third-party service. You are responsible for your own device, connectivity, and environment. Video sessions are not recorded by Confer unless expressly stated. The join window opens shortly before the scheduled time.
10. Cross-border consultations
Where a consulting surgeon is located outside the UAE, the consultation involves a cross-border transfer of de-identified case data, which proceeds only with your explicit, recorded consent. Patient identity is never transmitted across the border. You are responsible for understanding that a surgeon in another jurisdiction may be subject to different professional and regulatory frameworks.
11. Acceptable use
- Do not upload unlawful content or content you lack the right to share.
- Do not attempt to identify, de-anonymise, or contact a patient or surgeon outside the platform in breach of the identity firewall.
- Do not attempt to breach security, access data you are not authorised to access, or disrupt the service.
- Do not use the platform for emergencies, or for any purpose other than legitimate clinical second opinions.
- Do not misrepresent your identity, credentials, or authority.
12. Data & privacy
Your use of Confer is subject to our Privacy Policy, which explains how personal and health data are collected, protected (including encryption and the identity firewall), shared, transferred, and retained. By using Confer you acknowledge that policy.
13. Intellectual property
The Confer platform, its software, design, and trademarks are owned by their respective rights holders and may not be copied, modified, or reused without permission. Content you submit remains yours; you grant us the limited licence needed to operate the service (for example, to store, de-identify, transmit to an authorised consulting surgeon, and process the case).
14. Disclaimers
The platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the platform will be uninterrupted or error-free, or that any second opinion will achieve any particular result. Confer is not responsible for the clinical content of opinions, which are the responsibility of the providing surgeon.
15. Limitation of liability
To the maximum extent permitted by law, Confer and TBHCI, and their officers, employees, and processors, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any clinical outcome, decision, or reliance on any opinion obtained through the platform. Our aggregate liability arising out of or relating to the platform is limited to the fees you paid, if any, for the consultation giving rise to the claim.
16. Indemnity
You agree to indemnify and hold harmless Confer and TBHCI from claims arising out of your misuse of the platform, your breach of these Terms, or, for clinicians, the professional services you provide through the platform.
17. Suspension & termination
We may suspend or terminate access for breach of these Terms, suspected misuse, or where required for security or legal reasons. You may stop using the platform at any time; patients may delete their account from the account page.
18. Governing law
These Terms are governed by the laws of the United Arab Emirates, and you submit to the jurisdiction of the competent UAE courts, without prejudice to any mandatory consumer protections. The applicable Emirate and any arbitration or forum clause should be confirmed with counsel prior to launch.
19. Changes
We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance. Material changes will be indicated by updating the date above.
